Duterte Approves Night Shift Differential Pay To Gov’t Employees

Incumbent President Rodrigo Duterte recently signed a law granting night shift differential pay to government employees.

Republic Act No. 11701 is a measure that ensures government employees are given a night shift differential pay at a maximum rate of 20% of the employee’s hourly basic rate regardless of their nature of employment.

The hourly basic rate of the employee is determined by the head of the agency, for each hour of work done between 6 p.m. to 6 a.m.

The law also notes that the night shift differential pay shall not diminish any other employee benefits or allowances previously enjoyed by the employees.

The recently signed law covers all government employees occupying positions from Division Chiefs and below, including employees from government-owned and government-controlled companies.

Employees in these positions are covered by the newly signed law whether they are a permanent, contractual, temporary, or casual employee as long as they are on night shift.

Government employees not covered by the newly signed law are daytime workers, specifically those with office hours that fall within 6 a.m. until 6 p.m. All services rendered after 6 p.m. by those with daytime shifts shall be given an overtime pay according to existing laws.

Employees in the government who are on-call 24 hours are also not covered by the law. These includes personnel of:

  • Armed Forces of the Philippines (AFP)
  • Philippine National Police (PNP)
  • Bureau of Jail Management and Penology (BJMP)
  • Bureau of Fire Protection (BFP)
  • Any similar gov’t agencies determined by the Civil Service Commission (CSC) and the Department of Budget and Management (DBM)

Republic Act No. 11701 was signed into law last April 13. The copy of the law, however, was only made available to the public on Monday.
